1. Acceptance of these terms
These Terms & Conditions ("Terms") govern your use of the FXBG Digital website at fxbg.io and the services we provide ("Services"). By using our website, contacting us, or engaging our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website or Services.
2. Our services
FXBG Digital designs, rebuilds, hosts, and maintains websites for local businesses. Specific deliverables, timelines, and pricing for your project are described in the proposal or agreement we provide to you. Where a separate written agreement conflicts with these Terms, the separate agreement controls for that engagement.
3. SMS / text messaging terms
By providing your mobile phone number and opting in, you agree that FXBG Digital may send you text (SMS) messages related to your inquiry, project, appointment or account updates, and customer support.
- Consent is not a condition of purchase. You do not have to agree to receive texts in order to buy our Services.
- Message frequency varies based on your interaction with us.
- Message and data rates may apply, depending on your mobile carrier and plan.
- To opt out, reply STOP to any message at any time. You will receive one confirmation message and will not receive further texts unless you opt back in.

- Carriers are not liable for delayed or undelivered messages.
- Supported carriers may change, and messaging may not be available on all carriers.
No mobile information (including phone numbers) will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. See our Privacy Policy for details.
4. Fees & billing
Pricing for our Services, including any flat monthly fee, is set out in your proposal or agreement. Unless stated otherwise, monthly Services are billed in advance and continue until cancelled. Fees are non-refundable except where required by law or expressly stated in your agreement. We may update pricing on a going-forward basis with reasonable notice.
5. Your responsibilities
- Provide accurate information and the content, materials, and access we need to perform the Services.
- Ensure you own or have the rights to any content (text, images, logos) you provide to us.
- Use our website and Services lawfully and not to transmit harmful, infringing, or unlawful material.
6. Intellectual property
Content you provide remains yours. Upon full payment for a completed project, you own the final website deliverables we create for you, except for third-party components, open-source software, and any pre-existing tools or frameworks we use, which remain owned by their respective owners or by us and are licensed to you for use with your site. The FXBG Digital name, logo, and site content are our property.
7. Disclaimers
We provide our Services with reasonable care and skill. Except as expressly stated, the website and Services are provided "as is" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not guarantee specific search rankings, traffic, or business results.
8. Limitation of liability
To the fullest extent permitted by law, FXBG Digital will not be liable for any indirect, incidental, special, or consequential damages, or lost profits or revenue, arising from your use of the website or Services. Our total liability for any claim will not exceed the amount you paid us for the Services in the three (3) months before the claim arose.
9. Term & termination
Monthly Services continue until either party cancels as described in your agreement. You may cancel ongoing Services with reasonable notice; we may suspend or terminate Services for non-payment or breach of these Terms. On termination, provisions that by their nature should survive (such as payment obligations, intellectual property, disclaimers, and limitations of liability) will survive.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Virginia.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the website or Services after changes take effect means you accept the updated Terms.
